Since in Crete, Greece there is not yet a National Cadastral Registration System, the lawyer must investigate the property being purchased, is free and clear of legal problems (lien, mortgages, garnishments, expropriation, inheritance taxes etc.) at Land Registration Office of the area where the property is. Sometimes, it’s possible that the lawyer must check the property in more than one Land Registration Offices. The lawyer’s fee is at least 1% upon the first 44000€ of purchasing cost and 0,5% upon the exceeding amount of money. The lawyer’s fee can be increased up to 2% especially when the land registry search is complicated. A modern land registration system is under construction in Greece today.

The purchaser personally or his lawyer, must search to the local authority office for city planning for issues concerning House or building provisions, local stipulations or restrictions. Some times -especially when the property being purchased is a plot out of the city plan- the hiring of a civil engineer, who knows the area and its restrictions, is necessary.
Buying homes in Crete: Formalities and paperwork
All EU citizens have equal rights concerning the purchase or sale of property in Greece. Non-EU citizens are also free to buy property in Greece, however with some restrictions as described bellow. The documents required for signing a property-purchase contract are:

a) Both the buyer and the seller must provide:

- A valid passport (or a legal identity card for EU citizens only).

- A Greek fiscal number, which is obtainable by non-Greek citizens, within 5 working days by the Greek Tax Authorities.

b) The seller should provide a “clean” tax certificate issued by the competent Tax Authority, proving that he has no outstanding debts towards the State.

c) An additional special permission is required for the purchase of properties close to the Greek borders. Such permission will be issued by the local Department Authorities and is not granted to non-EU citizens.
Crete Homes buying and Taxation Transfer
In Greece transfer tax-rate is 9% on the first 15000€ of contract price and 11% on the exceeding amount of the contract price (not the real purchasing price), payable by the purchaser only. The declared contract price cannot be less than the published government value, which is substantially below the market value.
Crete Home buying: Public Notary-Contract
The purchase contract is written by a Public Notary and checked by both lawyers of the seller and the purchaser, who are present during the signing. The purchaser, who also pays his fee, selects the Notary. The public notary’s fee is 1,5% of the contract price (not the real purchasing price).

Registration fees

After the signing, the contract must be transcribed to the Land Registration Office. Crete Land registry fees are about 0.4% on the contract value plus a small sum for stamp duties and certificates.
